Copyright Policy

1. Introduction
Instantly (即店) ("we", "us", or "our") respects intellectual property rights and is committed to complying with the Copyright Ordinance (Cap. 528) of the Laws of Hong Kong, as amended by the Copyright (Amendment) Ordinance 2022.
As an online service provider, we act as an intermediary between merchants (who create storefronts from their Instagram content) and consumers. If you believe that content on an Instantly-powered storefront infringes your copyright, this page explains how to submit a complaint.
2. How to Submit a Copyright Complaint
To submit a copyright infringement notice, please send an email to support@instantlystore.com with the subject line "Copyright Complaint" and include the following information:
Your identity: your full legal name, postal address, telephone number, and email address. If you are acting on behalf of the copyright owner, include evidence of your authority to act (e.g. a signed letter of authorisation).
The copyrighted work: a description of the copyrighted work that you believe has been infringed. If multiple works are involved, please provide a representative list.
The infringing content: the specific URL(s) on Instantly where the allegedly infringing content appears. Please be as precise as possible so we can locate the material.
Good faith statement: a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
Accuracy statement: a statement that the information in your notice is accurate, and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
Signature: your physical or electronic signature (a typed full name is acceptable for electronic notices).
Incomplete notices may result in delays. We will contact you if additional information is required.
3. How We Process Complaints
Upon receipt of a valid copyright complaint, we will:
- Acknowledge receipt of your notice
- Review the complaint to verify it contains all required information
- Act by removing or disabling access to the allegedly infringing content within a reasonable time
- Notify the merchant whose content was affected, providing them with a copy of the complaint
4. Counter-Notice
If you are a merchant and believe your content was removed in error or is not infringing, you may submit a counter-notice. Detailed instructions for the counter-notice process will be published in a future update to this policy.
In the meantime, if you believe a takedown was made in error, please contact us at support@instantlystore.com with the subject line "Copyright Counter-Notice".
5. Repeat Infringers
We maintain a policy of terminating or suspending access for merchants who are the subject of repeated valid copyright complaints. Accounts with multiple upheld complaints may be permanently removed from the platform.
6. Legal Basis
This policy is designed to satisfy the safe harbour conditions for online service providers under the Copyright Ordinance (Cap. 528), as amended by the Copyright (Amendment) Ordinance 2022. The safe harbour provisions require that we:
- Maintain a publicly available policy for handling copyright complaints
- Designate a contact point for receiving infringement notices
- Act expeditiously upon receiving notification of alleged infringement
- Do not financially benefit directly from specific infringing activity
